CONSTRUCTION PROGRAMME
施工组织设计应包含以下内容：

（9）合同当事人约定的其他内容。

施工组织设计的提交和修改
Submission and Amendment of Construction Organization Design
除专用合同条款另有约定外，承包人应在合同签订后14天内，但至迟不得晚于第7.3.2项〔开工通知〕载明的开工日期前7天，向监理人提交详细的施工组织设计，并由监理人报送发包人。除专用合同条款另有约定外，发包人和监理人应在监理人收到施工组织设计后7天内确认或提出修改意见。对发包人和监理人提出的合理意见和要求，承包人应自费修改完善。根据工程实际情况需要修改施工组织设计的，承包人应向发包人和监理人提交修改后的施工组织设计。
Unless otherwise specifically indicated in the particular condition herein, the contractor should within 14 days subsequence to signature hereof, however not later than 7 days prior to the commence day which is stipulated in Article 7.3.2 [Commence Notice], submit the Construction Organization Design to the supervisor which shall transfer the design to the employer. Except otherwise stated in particular condition, the employer and the supervisor shall within 7 days following the receipt of the construction organization design make confirmation or amendment opinion thereof. The contractor should, on the reasonable opinions and requirements of the employer and the supervisor, effect amendment and perfection thereof. Provided that it is necessary to modify the design of the construction organization design according to actual situation of the project, the contractor shall submit to the employer and the supervisor the revised construction organization design.
施工进度计划的编制
Preparation of Construction Progress Schedule
承包人应按照第7.1款〔施工组织设计〕约定提交详细的施工进度计划，施工进度计划的编制应当符合国家法律规定和一般工程实践惯例，施工进度计划经发包人批准后实施。施工进度计划是控制工程进度的依据，发包人和监理人有权按照施工进度计划检查工程进度情况。
The contractor should pursuant to the stipulations of Article 7.2 [Construction Organization Design] submit detailed construction schedule which is prepared conforming to the provisions of the State law and general practice of engineering customs and usage and executed subsequent to the employers approval. The construction schedule is the basis for controlling the progress of the project, and the employer and the supervisor reserve the right to inspect the progress of the project in accordance with the construction schedule.
施工进度计划的修订 Revision of Construction Progress Schedule
施工进度计划不符合合同要求或与工程的实际进度不一致的，承包人应向监理人提交修订的施工进度计划，并附具有关措施和相关资料，由监理人报送发包人。
Provided that if the construction progress schedule is inconsistent with the contract’s requirements or the actual progress of construction, the contractor should submit the revised schedule which attached the relevant measures and information to the supervisor whom will transfer to the employer.
除专用合同条款另有约定外，发包人和监理人应在收到修订的施工进度计划后7天内完成审核和批准或提出修改意见。发包人和监理人对承包人提交的施工进度计划的确认，不能减轻或免除承包人根据法律规定和合同约定应承担的任何责任或义务。
Unless otherwise specified in the terms of particular condition hereof, the employer and the supervisor shall, within 7 days after receiving the revised construction schedule, complete examination and approval thereof, or provide the amendment opinions thereon. None of the confirmation of the employer and the supervisor on the progress schedule submitted by the contractor shall mitigate or waive the contractors any liability or obligation which is assumed by the contractor in accordance with the provisions of law and contract.
工程进度Project Schedule
双方应共同努力，按照附件四及时使工程竣工。建造期从开工日计算为____年，C可以经B同意延长竣工期。
The parties shall work together in order to endeavour to achieve he timely completion of the Project in accordance with the Project schedule as Annex 4 according to which the construction period shall be_____ years from the commencement date. However， C may extend the construction period upon the agreement of B.
The Contractor shall submit a detailed time programme to the Employer’s Representative within 28 days after receiving the Notice under Sub-Clause 8.1 [Commencement Date]. The Contractor shall also submit a revised programme whenever the previous programme is inconsistent with actual progress or with Contractor’s obligation. Each programme shall include:
在根据FIDIC金皮书8.1（开工日期）的规定收到通知后28天内，承包商应向业主代表提交详细的进度计划。当原进度计划与实际进度或承包商的义务不符时，承包商还应提交一份修改的进度计划。每份进度计划应包括：
the order in which the Contractor intends to carry out the Works, including the anticipated timing of each stage of design, Contractor’s Documents, procurement, manufacture, inspection, delivery to Site, construction, erection, testing, commissioning and trial operation;

Progress Schedule进度计划
The Contractor must present a detailed construction organization design and the progress schedule to the Employers Representative and the Engineers within 5 working days after receiving the move-in notice from the Employer. And the TKS Engineer and the Employers Representative shall make confirmation or propose modification opinions within days after receiving the afore mentioned documents, failure of which shall be deemed as the consents thereto.
承包人应在收到发包人书面进场通知后的5个工作日内，向发包人代表和工程师提交一份详尽的施工组织设计和工程进度计划。TKS工程师和发包人代表应在收到上述文件后的 天内确认或提出修改意见，逾期不确认也不提出书面意见的，视为同意。
The Contractor shall organize the construction works in accordance with the process schedule confirmed by the TKS Engineer and the Employer’s Representative and shall accept the inspection and supervision by the Engineers and the Employer’s Representative in respect of the Project’s schedule.
承包人必须按工程师和发包人代表确认的进度计划组织施工，接受工程师和发包人代表对进度的检查、监督。
The Contractor must submit improvement measurements within three days as required by the Engineers and/or the Employers Representative if the actual work progress is not in accordance with the confirmed schedule, and shall execute the improvement measurements after approved by the TKS Engineer and the Employers Representative. The Contractor has no right to claim Additional Contract Price for the improvement measures if the inconsistency between actual schedule and planned schedule is attributable to the Contractor.
工程实际进度与经确认的进度计划不符时，承包人应按工程师和/或发包人代表的要求在三天内提出改进措施，经TKS工程师和发包人代表确认后执行。因承包人的原因导致实际进度与进度计划不符，承包人无权就改进措施提出追加合同价款。

Programmer to be Submitted
承包商应当在中标函签发日之后，以工程师规定的适当格式和详细程度， 向工程师递交一份工程进度计划，以取得工程师的同意。无论工程师何时需要，承包商还应以书面形式提交一份对其进行工程施工所拟采用的安排和方法的总说明，以供参考。
The Contractor shall, within the time stated in these Conditions after the date of the Letter of Acceptance, submit to the Engineer for his consent a programme, in such form and detail as the Engineer shall reasonably prescribe, for the execution of the Works. The Contractor shall, whenever required by the Engineer, also provide in writing for his information a general description of the arrangements and methods which the Contractor proposes to adopt for the execution of the Works.
无论何时，如果工程师认为，工程的实际进度不符合第34.1款中已经同意的进度计划时，承包商应根据工程师的要求提出一份修订过的进度计划，表明为保证工程按期竣工而对原进度计划所作的修改。
If at any time it should appear to the Engineer that the actual progress of the Works does not conform to the programme to which consent has been given under Clause 34.1, the Contractor shall produce, at the request of the Engineer, a revised programme showing the modifications to such programme necessary to ensure completion of the works within the Time for Completion.

参加甲方组织的施工图纸或做法说明的现场交底，拟定施工方案和进度计划，交由甲方审定。施工过程中，乙方按照甲方的有关指示及修改变更要求进行相应调整。
Party B shall participate in the technical clarification on construction drawings and explanations of work procedures organized by Party A, and should develop the construction plan and the progress schedule for Party A to review. During construction, Party B should make such adjustment to the construction plan and the progress schedule per Party A's instruction and change-orders.

PROJECT CONSTRUCTION SHCEDULE 项目实施进度表
The EPC’s contractor shall complete their work within 30 months.
The project construction schedule is arranged based on the actual situations of all the main production lines of second stage revamping and expansion project to meet the requirements of whole project starting production.
承包商应在30个月内完成EPC合同中规定的工作。项目实施进度是根据二期扩建工程各主要生产线在项目整体投产过程中的需要来进行安排。
The Accepted Programme is the programme identified in the Contract Data or is the latest programme accepted by the Project Manager. The latest programme accepted by the Project Manager supersedes previous Accepted Programme.
已认可的施工进度计划是指合同资料中所确定的施工进度计划，或项目经理认可的最新施工进度计划。项目经理认可的最新施工进度计划将取代所有先前已认可的施工进度计划。
“进度计划”指在7.1款中定义的进度计划，它也可以按7.2款进行修改。
Time Schedule means the Time Schedule defined in Article 7.1, as may be altered according to Article 7.2。

Present the engineer the weekly progress schedule and relevant progress statistics. A monthly report is also requested.

The contractor must present the construction methods statement and the progress schedule to the engineer on the time stipulated in the contract special clauses. And the engineer makes confirmation or put forward different opinions on the time fixed in the special clauses. Otherwise, see that as agreement.

The contractor shall execute the construction works in accordance with the schedule approved by the engineer and will be checked and supervised by the engineer. The contractor must submit improvements s required by the engineer if the work progress is not in accordance with the schedule, and shall execute the improvements after approval by the engineer. The contractor shall not ask for supplemental payment for this improvement if it is him who causes the delay in the schedule.
承包人必须按工程师确认的进度计划组织施工，接受工程师对进度的检查、监督。工程实际进度与经确认的进度计划不符时，承包人应按工程师的要求提出改进措施，经工程师确认后执行。因承包人的原因导致实际进度与进度计划不符，承包人无权就改进措施提出追加合同价款。
为确保施工工期，甲方根据总工期（总工期以签定的合同工期为准）的要求，以周计划进行工期进度的安排，乙方必须严格按照甲方制定的周进度计划安排工作并确保其完成。
In the expectation of ensuring term of project party A will, pursuant to the requirement of general term which be subject to the term which is stipulated herein, make preparation of progress with weekly schedule with which party B should be in strict accordance, and ensure its accomplishment thereof.
根据下文第4.2款规定的要求，制订并定期更新项目的施工进度表，并协调分包商（包括供应商）的活动以确保对进度表的遵守。
Establishing and periodically updating a Construction Schedule for the Project, as required under Paragraph 4.2, below, and coordinating the activities of the Subcontractors (including suppliers) to assure adherence to the Schedule.
业主有权要求承包商在施工进度表中所示的日期前完成工程或其任何一部分，或即使承包商的延迟请求已根据通用条件第12条的规定被批准，仍然要求承包商按照施工进度表完成工程。业主根据本第4.4款要求的对工程进度的任何加速应限于承包商能合理达到的限度内，并且应使承包商有权获得一项变更指令，以涵盖任何其所承担的因该等加速工作所引起的额外成本。
The Owner shall have the right to require the Contractor to complete the Work or any part thereof before the date set forth in the construction Schedule, or to require the Contractor to complete the Work according to the Construction Schedule even though his claim for a delay has been approved under Article 12 of the General Conditions. Any acceleration in the progress of the Work required by the Owner under this Paragraph 4.4 shall be limited to that reasonably attainable by the Contractor and shall entitle the Contractor to a Change Order to cover any additional costs incurred by him as a result of the acceleration.
